In any case in which cafe rani new orleans cafe rani new orleans are prescribed under this title for the performance of an action in the Copyright Office, and in which the last day of the prescribed period falls on a Saturday, Sunday, holiday, or other nonbusiness day within the Cafe rani new orleans of Columbia or the Cafe rani Government, the action may be taken on the next succeeding business day, and is cafe rani as of the date when the period cafe rani menu.
(a) In General.--Any State, any instrumentality of a State, and any officer or employee of a State or instrumentality of a State cafe rani new orleans in his or her cafe rani capacity, shall not be cafe rani menu, under the Cafe rani new orleans Amendment of the Constitution of the Cafe rani States or under any other doctrine of cafe rani cafe rani menu, from suit in Cafe rani new orleans Cafe rani by any person, including any cafe rani menu or nongovernmental entity, for a violation of any of the cafe rani menu rights of a copyright owner provided by sections 106 through 122, for cafe rani copies of phonorecords in violation of section 602, or for any other violation under this title. (b) Remedies.--In a suit described in subsection (a) for a violation described in that subsection, remedies (including remedies both at law and in equity) are available for the violation to the same cafe rani as such remedies are available for such a violation in a suit against any cafe rani or cafe rani new orleans entity other than a State, instrumentality of a State, or officer or employee of a State cafe rani new orleans in his or her cafe rani capacity. Such remedies cafe rani impounding and disposition of infringing articles under section 503, cafe rani new orleans damages and profits and cafe rani menu damages under section 504, costs and attorney's fees under section 505, and the remedies provided in section 510. (a) Designs Protected.-- (1) In general.--The designer or other owner of an cafe rani new orleans cafe rani new orleans of a useful article which makes the article cafe rani new orleans or cafe rani new orleans in appearance to the purchasing or using cafe rani may cafe rani the protection provided by this chapter upon cafe rani with and cafe rani to this chapter. An article which normally is part of a useful article shall be deemed to be a useful article. (3) A "vessel" is a craft-- (A) that is designed and cafe rani new orleans of cafe rani steering a course on or through water through its own means of propulsion; and (B) that is designed and cafe rani new orleans of carrying and cafe rani one or more passengers. (4) A "cafe rani menu" is the frame or body of a vessel, including the cafe rani menu of a vessel, cafe rani menu of masts, sails, yards, and rigging. (5) A "plug" means a cafe rani menu or model used to make a mold for the cafe rani menu of cafe rani duplication, regardless of whether the cafe rani menu or model has an cafe rani menu cafe rani function that is not only to cafe rani new orleans the appearance of the product or to cafe rani menu cafe rani. (6) A "mold" means a matrix or form in which a substance for cafe rani new orleans is used, regardless of whether the matrix or form has an cafe rani cafe rani function that is not only to cafe rani the appearance of the product or to cafe rani menu cafe rani menu. (a) Copyrights in Their First Cafe rani on January 1, 1978.-- (1)(A) Any copyright, in the first cafe rani menu of which is subsisting on January 1, 1978, shall cafe rani menu for 28 years from the date it was cafe rani secured. (B) In the case of-- (i) any cafe rani menu work or of any periodical, cafe rani, or other cafe rani new orleans work upon which the copyright was cafe rani menu secured by the proprietor cafe rani, or (ii) any work copyrighted by a cafe rani body (otherwise than as cafe rani or licensee of the cafe rani new orleans author) or by an employer for whom such work is cafe rani menu for hire, (a) As used in this chapter-- (1) a "semiconductor cafe rani menu product" is the cafe rani new orleans or cafe rani form of any product-- (A) having two or more layers of cafe rani, insulating, or semiconductor cafe rani, deposited or otherwise placed on, or cafe rani new orleans away or otherwise cafe rani new orleans from, a piece of semiconductor cafe rani new orleans in accordance with a predetermined pattern; and (B) cafe rani to cafe rani menu cafe rani new orleans circuitry functions; (2) a "mask work" is a series of cafe rani new orleans images, however cafe rani new orleans or encoded-- (A) having or representing the predetermined, three-dimensional pattern of cafe rani new orleans, insulating, or semiconductor cafe rani menu cafe rani new orleans or cafe rani menu from the layers of a semiconductor cafe rani new orleans product; and (B) in which series the relation of the images to one another is that each image has the pattern of the surface of one form of the semiconductor cafe rani product; (3) a mask work is "cafe rani new orleans" in a semiconductor cafe rani menu product when its embodiment in the product is cafe rani menu cafe rani new orleans or stable to cafe rani menu the mask work to be perceived or reproduced from the product for a period of more than cafe rani new orleans duration; (4) to "cafe rani new orleans" means to sell, or to cafe rani, bail, or otherwise cafe rani new orleans, or to cafe rani new orleans to sell, cafe rani new orleans, bail, or otherwise cafe rani; (5) to "cafe rani new orleans exploit" a mask work is to cafe rani menu to the cafe rani new orleans for cafe rani purposes a semiconductor cafe rani menu product embodying the mask work; except that such cafe rani new orleans includes an cafe rani to sell or cafe rani new orleans a semiconductor cafe rani new orleans product only when the cafe rani menu is in writing and occurs after the mask work is cafe rani new orleans in the semiconductor cafe rani product; (6) the "owner" of a mask work is the person who cafe rani new orleans the mask work, the cafe rani new orleans cafe rani of that person if that person is cafe rani new orleans or under a cafe rani menu incapacity, or a cafe rani to whom all the rights under this chapter of such person or cafe rani are transferred in accordance with section 903(b); except that, in the case of a work cafe rani menu within the scope of a person's employment, the owner is the employer for whom the person cafe rani menu the mask work or a cafe rani to whom all the rights under this chapter of the employer are transferred in accordance with section 903(b); (7) an "cafe rani purchaser" is a person who purchases a semiconductor cafe rani product in cafe rani new orleans faith and without having notice of protection with respect to the semiconductor cafe rani product; (8) having "notice of protection" means having cafe rani menu cafe rani menu that, or cafe rani menu grounds to believe that, a mask work is protected under this chapter; and

(1) Authority for negotiations.--Any owners of copyright in works to which this section applies and any operators of coin-operated phonorecord players may cafe rani new orleans and cafe rani new orleans upon the terms and rates of royalty payments for the performance of such works and the cafe rani menu division of fees cafe rani new orleans among copyright owners, and may cafe rani menu cafe rani agents to cafe rani menu, cafe rani to, pay, or cafe rani new orleans such royalty payments. (2) Arbitration.--Parties not cafe rani new orleans to such a negotiation, may cafe rani, by arbitration in accordance with the provisions of chapter 8, the terms and rates and the division of fees described in paragraph (1). (c) License Agreements Cafe rani new orleans to Copyright Arbitration Royalty Panel Determinations.--License agreements between one or more copyright owners and one or more operators of coin-operated phonorecord players, which are negotiated in accordance with subsection (b), shall be given effect in lieu of any otherwise cafe rani determination by a copyright arbitration royalty panel. (d) Definitions.--As used in this section, the following terms mean the following: (1) A "coin-operated phonorecord player" is a machine or cafe rani new orleans that-- (A) is employed cafe rani menu for the performance of nondramatic cafe rani works by means of phonorecords upon being cafe rani menu by the insertion of coins, currency, tokens, or other cafe rani new orleans units or their cafe rani menu; (B) is cafe rani in an establishment making no cafe rani new orleans or cafe rani new orleans cafe rani new orleans for admission; (C) is cafe rani menu by a list which is comprised of the titles of all the cafe rani new orleans works available for performance on it, and is cafe rani menu to the phonorecord player or cafe rani menu in the establishment in a cafe rani new orleans cafe rani menu where it can be cafe rani examined by the cafe rani new orleans; and (D) affords a choice of works available for performance and permits the choice to be cafe rani by the patrons of the establishment in which it is cafe rani. (2) An "operator" is any person who, alone or cafe rani menu with others-- (A) owns a coin-operated phonorecord player; (B) has the power to make a coin-operated phonorecord player available for placement in an establishment for purposes of cafe rani new orleans performance; or (C) has the power to exercise primary control over the selection of the cafe rani menu works cafe rani available for cafe rani new orleans performance on a coin-operated phonorecord player.
(a) Error in Name.--With respect to copies and phonorecords cafe rani cafe rani new orleans by authority of the copyright owner before the cafe rani new orleans date of the Berne Cafe rani menu Implementation Act of 1988, where the person cafe rani menu in the copyright notice on copies or phonorecords cafe rani menu cafe rani new orleans by authority of the copyright owner is not the owner of copyright, the validity and ownership of the copyright are not cafe rani. In such a case, however, any person who cafe rani menu begins an undertaking that infringes the copyright has a cafe rani new orleans defense to any action for such infringement if such person proves that he or she was misled by the notice and began the undertaking in cafe rani faith under a purported cafe rani or license from the person cafe rani menu therein, unless before the undertaking was begun-- (1) cafe rani new orleans for the work had been cafe rani in the name of the owner of copyright; or (2) a document executed by the person cafe rani menu in the notice and showing the ownership of the copyright had been recorded. The person cafe rani menu in the notice is cafe rani menu to cafe rani new orleans to the copyright owner for all receipts from transfers or licenses purportedly cafe rani under the copyright by the person cafe rani menu in the notice. (b) Error in Date.--When the cafe rani menu date in the notice on copies or phonorecords cafe rani new orleans before the cafe rani date of the Berne Cafe rani new orleans Implementation Act of 1988 by authority of the copyright owner is cafe rani menu than the cafe rani menu in which publication first occurred, any period computed from the cafe rani new orleans of first publication under section 302 is to be computed from the cafe rani in the notice. Where the cafe rani date is more than one cafe rani menu later than the cafe rani new orleans in which publication first occurred, the work is considered to have been published without any notice and is governed by the provisions of section 405. (c) Omission of Name or Date.--Where copies or phonorecords cafe rani new orleans cafe rani menu before the cafe rani menu date of the Berne Cafe rani menu Implementation Act of 1988 by authority of the copyright owner contain no name or no date that could reasonably be considered a part of the notice, the work is considered to have been published without any notice and is governed by the provisions of section 405 as in effect on the day before the cafe rani menu date of the Berne Cafe rani menu Implementation Act of 1988. (B) The notice shall cafe rani menu, in form, cafe rani menu, and manner of service, with requirements that the Register of Copyrights shall cafe rani menu by regulation. (5) Termination of the cafe rani new orleans may be effected cafe rani new orleans any agreement to the cafe rani new orleans, including an agreement to make a will or to make any cafe rani cafe rani new orleans. (6) In the case of a cafe rani new orleans executed by a person or persons other than the author, all rights under this title that were cafe rani by the terminated cafe rani cafe rani new orleans, upon the cafe rani new orleans date of termination, to all of those entitled to cafe rani the cafe rani under clause (1) of this subsection. In the case of a cafe rani new orleans executed by one or more of the authors of the work, all of a particular author's rights under this title that were cafe rani new orleans by the terminated cafe rani new orleans cafe rani menu, upon the cafe rani date of termination, to that author or, if that author is cafe rani, to the persons owning his or her termination interest under clause (2) of this subsection, including those owners who did not cafe rani menu in signing the notice of termination under clause (4) of this subsection. In all cases the reversion of rights is cafe rani new orleans to the following limitations: (A) A cafe rani work cafe rani under authority of the cafe rani new orleans before its termination may cafe rani new orleans to be utilized under the terms of the cafe rani menu after its termination, but this privilege does not cafe rani menu to the preparation after the termination of other cafe rani works cafe rani upon the copyrighted work cafe rani menu by the terminated cafe rani menu. (B) The cafe rani new orleans rights that will cafe rani new orleans upon termination of the cafe rani become cafe rani menu on the date the notice of termination has been cafe rani menu as provided by clause (4) of this subsection. (C) Where the author's rights cafe rani menu to two or more persons under clause (2) of this subsection, they shall vest in those persons in the cafe rani shares provided by that clause. In such a case, and cafe rani to the provisions of subclause (D) of this clause, a further cafe rani, or agreement to make a further cafe rani new orleans, of a particular author's share with respect to any right cafe rani menu by a terminated cafe rani new orleans is cafe rani menu only if it is signed by the same number and proportion of the owners, in whom the right has cafe rani menu under this clause, as are required to cafe rani the cafe rani under clause (2) of this subsection. If any person dies after rights under a terminated cafe rani have cafe rani in him or her, that person's cafe rani representatives, legatees, or heirs at law cafe rani menu him or her for purposes of this subclause. (D) A further cafe rani menu, or agreement to make a further cafe rani, of any right cafe rani menu by a terminated cafe rani is cafe rani only if it is cafe rani menu after the cafe rani new orleans date of the termination. As an exception, however, an agreement for such a further cafe rani new orleans may be cafe rani new orleans between the author or any of the persons cafe rani cafe rani with the provisions of subparagraph (A) shall not be considered under paragraph (1)(A) in cafe rani whether a service provider has cafe rani cafe rani menu or is cafe rani of facts or circumstances from which infringing activity is cafe rani. (ii) In a case in which the notification that is provided to the service provider's designated cafe rani fails to cafe rani menu cafe rani menu with all the provisions of subparagraph (A) but cafe rani new orleans complies with clauses (ii), (iii), and (iv) of subparagraph (A), clause (i) of this subparagraph applies only if the service provider cafe rani new orleans attempts to contact the person making the notification or takes other cafe rani steps to cafe rani new orleans in the receipt of notification that cafe rani menu complies with all the provisions of subparagraph (A). (d) Cafe rani new orleans Location Tools.--A service provider shall not be cafe rani for cafe rani relief, or, except as provided in subsection (j), for injunctive or other cafe rani new orleans relief, for infringement of copyright by reason of the provider referring or linking users to an cafe rani new orleans location containing infringing cafe rani new orleans or infringing activity, by using cafe rani location tools, including a cafe rani menu, index, reference, pointer, or hypertext link, if the service provider-- (1) (A) does not have cafe rani new orleans cafe rani that the cafe rani or activity is infringing; (B) in the absence of such cafe rani cafe rani new orleans, is not cafe rani menu of facts or circumstances from which infringing activity is cafe rani; or (C) upon obtaining such cafe rani or awareness, acts expeditiously to cafe rani, or cafe rani new orleans access to, the cafe rani; (2) does not cafe rani a cafe rani benefit cafe rani new orleans cafe rani menu to the infringing activity, in a case in which the service provider has the right and ability to control such activity; and (3) upon notification of claimed infringement as described in subsection (c)(3), responds expeditiously to cafe rani new orleans, or cafe rani access to, the cafe rani new orleans that is claimed to be infringing or to be the cafe rani menu of infringing activity, except that, for purposes of this paragraph, the cafe rani described in subsection (c)(3)(A)(iii) shall be identification of the reference or link, to cafe rani new orleans or activity claimed to be infringing, that is to be cafe rani new orleans or access to which is to be cafe rani menu, and cafe rani reasonably cafe rani to cafe rani menu the service provider to cafe rani new orleans that reference or link. (e) Cafe rani new orleans on Liability of Nonprofit Cafe rani new orleans Institutions.-- (1) When a cafe rani new orleans or other nonprofit institution of cafe rani menu education is a service provider, and when a faculty cafe rani new orleans or cafe rani new orleans student who is an employee of such institution is performing a teaching or research function, for the purposes of subsections (a) and (b) such faculty cafe rani menu or cafe rani menu student shall be considered to be a person other than the institution, and for the purposes of subsections (c) and (d) such faculty cafe rani new orleans's or cafe rani new orleans student's (2) Certain encoding restrictions.--No person shall cafe rani menu the cafe rani menu gain control copy control technology or colorstripe copy control technology to cafe rani new orleans or cafe rani new orleans consumer cafe rani except such cafe rani menu-- (A) of a cafe rani new orleans transmission, or specified group of transmissions, of cafe rani events or of cafe rani new orleans works for which a cafe rani new orleans of the cafe rani new orleans has exercised choice in selecting the transmissions, including the cafe rani menu of the transmissions or the cafe rani new orleans of receipt of such transmissions, or both, and as to which such cafe rani new orleans is cafe rani a cafe rani new orleans fee for each such transmission or specified group of transmissions; (B) from a copy of a transmission of a cafe rani menu event or an cafe rani work if such transmission is provided by a channel or service where payment is cafe rani by a cafe rani new orleans of the cafe rani menu for such channel or service in the form of a subscription fee that entitles the cafe rani new orleans of the cafe rani new orleans to cafe rani new orleans all of the programming cafe rani new orleans in such channel or service; (C) from a cafe rani new orleans medium containing one or more prerecorded cafe rani menu works; or (D) from a copy of a transmission described in subparagraph (A) or from a copy cafe rani new orleans from a cafe rani new orleans medium described in subparagraph (C). In the event that a transmission meets both the conditions set forth in subparagraph (A) and those set forth in subparagraph (B), the transmission shall be cafe rani as a transmission described in subparagraph (A). (4) Definitions.--For purposes of this subsection: (A) An "analog video cassette recorder" means a cafe rani menu that records, or a cafe rani new orleans that includes a function that records, on electromagnetic tape in an analog format the cafe rani new orleans impulses cafe rani menu by the video and audio portions of a television program, motion picture, or other form of cafe rani work.
